Terms and conditions

1. Defining elements

The general terms and conditions set out below apply to all sales of goods and services by Arcana Inn, through the online store www.arcanainn.ro, to the Buyer, and may be modified at any time by Arcana Inn.

Definitions:

  • Buyer – a natural person / legal entity or other legal entity that places an Order.
  • Seller – the company EPICCARDS S.R.L., with its registered office in Bucharest, Strada Nicolae Nicoleanu 18, Sector 1, Trade Register registration number J40/11801/2024, Tax ID 50230529.
  • Goods and Services – any product or service, including the documents and services mentioned in the Order, to be supplied by the Seller to the Buyer.
  • Order – an electronic document that acts as a form of communication between the Seller and the Buyer, by which the Seller agrees to deliver the Goods and Services and the Buyer agrees to receive these Goods and Services and pay for them.
  • Confirmed Order – completed at the moment the products leave the Arcana Inn warehouse, accompanied by all the documents related to the order.
  • Contract – an Order confirmed by the Seller.
  • Specifications – all specifications and/or descriptions of the Goods and Services as stated in the Order.

2. Contractual documents

By placing an electronic or telephone Order on the website www.arcanainn.ro, the Buyer agrees to the form of communication (by telephone or email) through which the Seller conducts its operations.

The Order will be made up of the following documents, in order of importance:

  2. The Order (together with clear details of the delivery and billing information) and its specific conditions. The invoice is found in the Shopify order. You can click the "view order" button in the email and download the invoice.
  4. The Buyer's Specifications (where applicable).
  6. Terms and conditions.

If the Seller confirms the Order, this will imply full acceptance of the terms of the Order. The Seller's acceptance of the Order is deemed complete when there is a verbal (telephone) and/or electronic (email) confirmation from the Seller to the Buyer, and the product or products leave the Arcana Inn warehouse, without requiring an acknowledgement of receipt from the Buyer. The Seller at no point considers an unconfirmed order to have the value of a Contract.

  2. Pre-order products are limited to a single product per customer. In this way we try to limit the possibility of scalping.

The prices of the products in the order are valid for 2 business days from the date the order is registered.

3. Extent of the Seller's obligations

  2. The Seller will use its professional and technical knowledge to achieve the result stipulated in the Order and will deliver the Goods and Services that meet the Buyer's requirements, needs and specifications.
  4. The information presented on the Seller's websites is for guidance and may be modified by the Seller without prior notice. Also, for internal reasons related to space and/or the coherence of the information structure, product descriptions may be incomplete; however, the Seller makes efforts to present the most correct and relevant information so that the product is used within the parameters for which it was purchased.
  6. Communication with the store can be done by interacting with it, posting opinions about products, or communicating via the addresses mentioned in the "Contact" section. Opinions or messages containing insults or inappropriate language will be excluded from the site or ignored. The Seller is free to manage the information received without having to provide justifications for doing so.

4. Assignment and subcontracting

The Seller may assign and/or subcontract a third party for services related to fulfilling the Order, informing the Buyer, without the Buyer's consent being required. The Seller will always be responsible to the Buyer for all contractual obligations.

5. Intellectual and industrial property rights

The Buyer understands intellectual property rights and will not disclose to a third party or make public (on the internet or in the media) any of the information received from the Seller.

In addition, the name of the site as well as the graphic symbols are registered trademarks owned by EPICCARDS S.R.L. and may not be taken, copied or used without the written consent of the owner.

6. Confidentiality – advertising

Information of any kind provided by the Buyer to the Seller will remain the property of the Seller. It may be used only for the performance of the Contract/Order and may be made known only with the written consent of the Seller and after obtaining a confidentiality commitment from the recipient.

No public statement, promotion, press release or any other means of disclosure to third parties will be made by the Buyer regarding the Order without the prior written consent of the Seller.

Arcana Inn's messages are transmitted through specialized partners approved by Arcana Inn. In this way the confidentiality and security of the information is ensured.

By transmitting information or materials through this site, you grant the Seller unrestricted and irrevocable access to them, the right to use, reproduce, display, modify, transmit and distribute these materials or information. You also agree that the Seller may freely use, in its own interest, these ideas, concepts, know-how or techniques that you have sent us through the website www.arcanainn.ro. Arcana Inn will not be subject to any obligations regarding the confidentiality of the information sent, unless the legislation in force provides otherwise.

By registering in the Arcana Inn database, the Buyer gives their express consent, within the limits of the legislation in force, to be contacted by third parties, partners of Arcana Inn, marketing service providers, other service providers, state or government agencies (where specific legislation requires this), other companies with which Arcana Inn may develop joint programs for offering our products and services on the market, etc.

This website uses its own and third-party cookies to provide visitors with a much better browsing experience and services tailored to each person's needs and interests.

7. Deadlines / penalties

If the deadlines for delivery and/or starting the Order cannot be met, the Seller is obliged to inform the Buyer of the estimated date for completing the delivery. The Buyer will have the right to claim additional damages from the Seller, where permitted by law, in the event of total or partial failure by the Seller to perform the Contract in accordance with the established deadlines.

If the Seller receives erroneous information regarding the billing or delivery of the products, a new deadline for fulfilling the order will be set, falling within 5 business days.

8. Billing – payments

The prices of the products and services displayed on the website www.arcanainn.ro include VAT in accordance with the law in force.

The price, payment method and payment term are specified in the Order. The Seller will issue the Buyer an invoice for the Goods and Services delivered, with the Buyer being obliged to provide all the information necessary for issuing the invoice in accordance with the legislation in force.

The Seller will send the Buyer the invoice for the Order, as well as for any other payments related to the Order, exclusively in electronic format, by adding the invoice to the Buyer's Account or by email, to the email address specified by the Buyer in their Account.

For the correct communication of the invoice related to the Order, the Buyer is obliged to update their Account details whenever necessary and to access the information and documents related to each Order, available in their Account.

Through this means of communication, the Buyer, by accessing their Account, will have a record of the invoices issued by Arcana Inn, being able in turn to save and archive them at any time and in any manner they wish.

By submitting the Order, the Buyer expresses their agreement to receive invoices in electronic format by Arcana Inn adding them to the customer Account or by email, to the email address specified in their Account.

9. Risks and responsibilities

a. Delivery. The Seller undertakes to ship the Goods and Services by door-to-door courier to the Buyer or to the Arcana Inn showrooms, according to the Customer's choice.

b. Transport – packaging. Unless otherwise agreed by the Seller and Buyer, the Seller is discharged of the risks and responsibilities associated with the Goods and Services at the moment they are handed over to the domestic courier company with which the Seller works or to the Buyer's representative. The Seller will ensure the proper packaging of the Goods and Services and will ensure the transmission of the accompanying documents. The Seller will deliver the Goods and Services within Romania. If, upon delivery, the packaging of the Goods and Services is damaged, the Seller recommends that the Buyer refuse the Goods or Services. Otherwise, any subsequent complaint regarding these aspects is considered void.

10. Acceptance

Acceptance will be made when the Goods and Services comply with the technical characteristics mentioned in the Order. If the Buyer discovers that the Products delivered or Services supplied do not comply with the technical specifications, then the Seller will bring the Products and Services into conformity.

10 bis. Right of withdrawal (14-day return)

As a consumer, the Buyer has the right to withdraw from the distance sales contract, without giving any reason, within 14 calendar days of the date they take physical possession of the products, in accordance with OUG no. 34/2014. Withdrawal is notified by a clear request to the email address contact@arcanainn.ro, and the products are returned within no more than 14 days of the notification, in the condition in which they were received.

The Buyer is liable for any diminished value of the products resulting from handling them beyond what is necessary to establish their nature and characteristics. Sealed products (boosters, displays, bundles, etc.) that are unsealed/opened lose their value, since the contents are random; in this case the refund may be reduced proportionally or refused to the extent that the value has been compromised by opening. The cost of return shipping is borne by the Buyer, except for defective/non-compliant products. The refund is made within no more than 14 days of the notification, using the same payment method.

11. Warranties

All products sold through the website www.arcanainn.ro benefit from warranty conditions in accordance with the legislation in force and the commercial policies of the manufacturers. The products are new, in their original packaging, and come from sources authorized by each manufacturer.

In the case of products sold and delivered by Arcana Inn, the warranty certificates are issued directly by the manufacturer, which has a service network.

In the case of warranty certificates issued by manufacturers, a product reported as defective during the warranty period must be presented directly to the nearest service center mentioned in the certificate. This manufacturer-authorized center will take on the entire responsibility for resolving the warranty.

The absence of a product's warranty certificate must be reported within a maximum of 48 hours of receiving the goods, to contact@arcanainn.ro. Any subsequent notice will not be taken into account.

12. Transfer of ownership

Ownership of the Goods and Services will be transferred upon delivery, after payment by the Buyer at the location indicated in the Order (delivery being understood as signing for receipt of the transport document provided by the courier, or signing for receipt on the fiscal invoice in the case of deliveries made by the Seller's staff). In the case of delivery by courier, the courier is authorized by the Seller to allow the Buyer to open the parcels only after signing for delivery and paying any value due for them.

13. Liability

The Seller cannot be held responsible for damages of any kind that the Buyer or any third party may suffer as a result of the Seller fulfilling any of its obligations under the Order, and for damages resulting from the use of the Goods and Services after delivery, and in particular for the loss of the products.

The Seller will be liable if its subcontractors and/or partners of any kind involved in fulfilling the Order fail to fulfill any of the contractual obligations.

14. Processing of personal data

EPICCARDS S.R.L. processes personal data in accordance with Regulation (EU) 2016/679 (GDPR) and Law no. 190/2018. EPICCARDS S.R.L. is obliged to administer, securely and only for the specified purposes, the personal data you provide us about yourself.

The purpose of collecting the data is:

  • informing users and/or customers about the status of their account on www.arcanainn.ro;
  • informing them about the progress and status of orders;
  • evaluating the products and services offered;
  • promoting products and services;
  • marketing, advertising, media, administration, development, market research, statistics, tracking and monitoring of sales and consumer behavior.

By completing your details in the account creation and/or Order form, you declare that you accept your personal data being included in the EPICCARDS S.R.L. database and you give your consent for this personal data to be stored, used and processed by EPICCARDS S.R.L. for the purposes mentioned above, within the limits of the legislation in force.

By reading these Terms and Conditions, you have acknowledged that you are guaranteed the rights provided by the GDPR, namely the right to information, the right of access to data, the right to rectification, the right to erasure ("the right to be forgotten"), the right to restriction of processing, the right to data portability, the right to object, the right not to be subject to an automated individual decision, and the right to address the National Supervisory Authority for Personal Data Processing (ANSPDCP) and the courts.

On the basis of a written, dated and signed request sent to the address EPICCARDS S.R.L. – Bucharest, Bd. Ferdinand I, No. 126A, Sector 2, or by email to contact@arcanainn.ro, you may exercise the above rights free of charge.

www.arcanainn.ro may notify users/customers about current offers through its weekly newsletter and may send greetings, gift coupons or other special messages. Arcana Inn does not promote SPAM. Any user/customer who has explicitly provided their email address on the website www.arcanainn.ro may opt to have it removed from our database.

The information you provide us will be used for the purpose for which you provided it, to administer, support and evaluate our services and to prevent breaches of security, the law and our contractual terms.

Also, www.arcanainn.ro may provide your personal data to other companies with which it has partnership relations, but only on the basis of a confidentiality commitment from them, by which they guarantee that this data is kept secure and that the provision of this personal information is done in accordance with the legislation in force, as follows: providers of marketing, courier, payment/banking or other services.

Your personal information may also be provided to the Prosecutor's Office, the Police, the courts and other authorized state bodies, on the basis of and within the limits of legal provisions and as a result of expressly formulated requests.

15. Force majeure

Neither party will be liable for the non-performance of its contractual obligations if such non-performance is due to a force majeure event. Force majeure is an unforeseeable event, beyond the control of the parties, that cannot be avoided.

The Seller reserves the right to refuse to do business with the Buyer if the latter uses inappropriate language.

The Seller reserves the right to request advance payment for the Goods and Services if the Buyer has a history of abusively refused orders.

16. Applicable law – jurisdiction

This contract is subject to Romanian law. Any disputes arising between EPICCARDS S.R.L. and users/customers/buyers will be resolved amicably or, if this is not possible, the disputes will be settled by the competent Romanian courts.

Delivery

Products purchased from https://arcanainn.ro (EpicCards S.R.L.) are delivered by Sameday. The delivery time is 1–5 business days. Most orders are delivered the next day if the order is placed by 12:00.

Products can be picked up from the premises at Bd. Ferdinand I, no. 126A, Sector 2, Bucharest, if courier delivery is not wanted.
